PRENUPTIAL AGREEMENT
A prenuptial agreement is an agreement between spouses, or prospective spouses, that determines whether some or all of the property is to be considered as private property. What distinguishes individual property is that it is not to be included in a future division of the estate. This means that individual property will not be taken into account in the event of a divorce or in the event of the death of one of the spouses.
For a prenuptial agreement to be valid, it must be in writing and signed by both spouses. The prenuptial agreement must be registered with the Swedish Tax Agency (Skatteverket). If the spouses wish to change the prenuptial agreement, they must draw up a new agreement, which must be signed by both spouses and registered again.
Disagreements and disputes may arise, for example, in cases where the declared property or its possible proceeds are not sufficiently specified. Therefore we recommend that the agreement is drawn up with the help of an experienced lawyer.
