JOINT OWNERSHIP AGREEMENT

Ownership of property owned by more than one person is called joint ownership. The rights and obligations of the co-owners are governed by the regulations of the Joint Ownership Act.

It is a common misconception that the larger the share someone owns in a co-owned property, the more control they have over its management. Instead, any action or decision requires agreement between all co-owners, with certain exceptions for emergencies.

There is freedom of contract between co-owners. The partners can agree that different rules apply than those laid down in the joint ownership law. We recommend that expert advice be taken on how a joint ownership agreement should be drafted.
